EVALUATION OF THE EFFECTIVENESS OF THE JUDICIAL PROTECTION OF THE RIGHTS OF LOCAL SELF-GOVERNMENT

Turning to the topic of evaluation of the effectiveness of judicial protection of the rights of local self-government the author recognized the need for clear assessment criteria that will allow to solve the urgent problem of increasing the efficiency of the judicial forms of protection of rights and to achieve real protection of the rights of local self-government. For this, the author sets the task of establishing a legal framework for the protection of the rights of local government, clarification of the notion of "judicial protection of rights", establishment of the factors influencing the effectiveness of protection of the rights and development of criteria for the evaluation of the effectiveness of this form of rights protection. In result of the conducted research the author came to the conclusion that the effectiveness of judicial protection of rights is an evaluation category, which has influence not only the state of the system administration and the judicial system as a whole, but "temporary" and "performance" factors. As criteria for evaluating the effectiveness of the judicial protection of the rights of local government criteria are proposed need, purpose and correlation. These results are used in scientific research related to the judicial protection of human rights and local self-government. Practical significance of the obtained results consists in possibility of their use in law enforcement, in making a specific judicial decisions and evaluating those decisions. In addition, such use of the results of this work can have a positive impact on the further development of legal regulation of local self-government. The results can be used in the teaching of scientific disciplines in legal educational institutions of higher and secondary special education.
