Abstract:
The Constitution of the Kingdom of Serbia of 1888 has consistently implemented the principle of separation of powers. A special place in the system of separation of powers was occupied by an independent judiciary. It was represented by a system of courts, the top of which was occupied by the Court of Cassation. The Constitution of 1888 not only laid the basic principles of the administration of justice by an independent judiciary, but also the legal basis for organizing the judicial system of Serbia. With the adoption of the Constitution of 1888, conditions were created for the real introduction into the judicial system of Serbia of a jury trial. The Constitution established the procedure and conditions for the appointment and dismissal of judges, as well as the fundamental principles of the legal status of the Serbian judge: the principles of independence, incompatibility, irremovability of judges. Constitutional regulation of organization of the judiciary in the Kingdom of Serbia in the late nineteenth century is the subject of this article.
