Abstract:
The article attempts to justify the use of the notions of legal personality in succession law. The peculiarities of hereditary legal capacity, inheritance of hereditary legal capacity and delictual allowed the author to conclude that, by analogy with the civil legal personality, entities of the succession law have a hereditary personality, which elements are identical to elements of the civil legal personality. However, their content and other legal characteristics are the essential features that are allowed to carry a hereditary personality to self-view of personality. Among the revealed features the author calls the moment of emergence and the maintenance of inherited capacity, lack of differentiation of hereditary disability types, specific elements has also inherited delictual.
