REPUTATIONAL GUARANTEES IN THE RIGHT OF INDIA

In this article the author explores the concept, the essence of the guarantee / bank guarantee as a way to enforce the obligations in Indian law, and particularly reputational guarantees the right of India as one of the types of guarantees in Indian law. In preparing this article, the author used the dialectical method of analysis, research and educational opportunities that allow you to identify reputational guarantee, as a type of guarantee of the right to India. To prepare this article the author used the books and articles of British and Indian scientists, legal scholars, such as Wood Ph.R, Sir Dinshaw Fardunji Mulla, According to the results of this achievement: 1. The fact that the Contract of guarantee governed by the Indian law is a tripartite agreement; 2. That the Indian legislation regulates such types of guarantees as "reputational" guarantees. This type of guarantees secures the obligations of the parties to prevent bribery, non-providing any gifts, a variety of information related to the tender, etc.
