Abstract:
Aims: To identify presumption problems of awareness employer about a pregnant worker in the event of dismissal through the prism of law enforcement. Model: The methodological research basis on a general scientific dialectical method, which involves an objective and comprehensive knowledge of the phenomena under analysis, beside that formal-logical and system methods were used. Conclusions: Based on the analysis of law enforcement practice is a set of conclusions. Firstly, investigated cases of illegal dismissal of pregnant while downsizing or state, if the employer has not been informed of the pregnant workers. Secondly, analyzes the cases of judicial practice in which the employee learned of the pregnancy after the dismissal by the employer. Thirdly, it is concluded that realizing the abuse of pregnant workers of their rights, the court can not deny her a remedy for such a ground for refusal to comply with the requirements as "a finding of abuse of an employee of their rights" in the labor legislation of the Russian Federation does not attaching. Fourth, the state of pregnancy concealment to dismiss workers Resolution of the Plenum of the Russian Armed Forces from 17.03.2004g. №2 not classified as abuse of rights. Fifth, the full protection of the pregnant can provoke abuse of their pregnant women's rights, moreover, that the labor legislation of a pregnant worker shall not be obliged to inform the employer of finding pregnant at the time of dismissal. Even if there is such a pregnant employee's intention, the law provides the procedure for and the form of such notification. Scope of the research: The authors of the study attempted to provisions the Labour Code of the Russian Federation law enforcement, as well as the available science point of view with respect to the test institute. Practical importance: The results of this study can be used in the practical work of the law enforcer, such as: judges, legal practitioners, lawyers, professors of legal disciplines. Originality / value: The present study reflects a particular approach to the test subject. It is likely that both among theorists and practitioners there are many opponents of the proposed copyright views. In this regard, I think, the full protection of the pregnant can provoke abuse of their rights, especially since the labor legislation to such worker shall not be obliged to inform the employer of finding pregnant at the time of dismissal. Even if there is such a pregnant employee's intention, the law provides the procedure for and the form of such notification.
