Legal nature agreements on the payment of child support by the Russian Federation legislation

Traditionally, family law is a branch of law with the prevailing mandatory regulation method. Numerous transformations taking place in the last decade in the country, could not make changes to the approach of the legislator to the settlement of maintenance relations in Russia. The new Family Code the legislator has attempted to expand the rights of parents to independent, voluntary settlement alimentirovaniya minors. new institute agreement to pay alimony for minors was introduced. Unfortunately, the lack of any experience in the application of treaty principles in family relations entails a lot of enforcement problems. The article is devoted to the complex research of features of civil and family law as branches of private institutions. The author traces the preconditions for the emergence and formation of family law as an independent branch. In the article attention is paid to the study of the characteristic features of the branches of law, namely, the subject and method of regulation. The main objective of this article is to determine the place of family law, in particular, agreements of maintenance on the system of civil law relations. The article explains the importance of the development of methods to control discretionary maintenance obligations, analyzed the legal framework for implementation of agreements alimentirovanii as the appropriate legal guarantees to protect the rights and interests of minors. The problems of concepts and specific maintenance obligations, grounds of their appearance, especially legal obligations under the maintenance of minors. On the basis of the research the author proposes to specify the role of branches of law regulating the relations of civil turnover and select Tools control methods, various civil rights and family.
