Some features of the order of inheritance of insurance payments under insurance contracts

The purpose of this research is to determine the characteristics of the order of inheritance of insurance payments under insurance contracts, and development of recommendations for resolution of problems in law enforcement. Methodological basis of research is the general scientific dialectic method, which assumes the objectivity and comprehensiveness of knowledge of the studied phenomena. The research employed system, comparative legal, logical methods of scientific knowledge. During the study we came to the conclusion that the legislation on compulsory insurance of civil liability of vehicle owners and carriers should be supplemented with provisions on the procedure for obtaining the beneficiaries or heirs of the insurance indemnity for damage to property of the deceased. In the case of inadequate execution by the insurer of the obligation for payment of insurance compensation under the contract of voluntary insurance to the heir of the insured, whose property was damaged, subject to the provisions of the legislation on consumer protection. In addition, in some cases, the right to receive insurance payments in the case of death of a special entity whose life is insured under the contract of public insurance, belongs to the heirs, and in some cases members of his family and dependents. The practical significance of the research is that the conclusions and suggestions can be used in the improvement of the legislation on inheritance and insurance, and also in enforcement activity of the courts. The results of the research can be used in teaching courses: «Civil law», «Inheritance law», «Insurance law», in preparing study guides, scientific works. The value of this research lies in the fact that the proposed changes in the legislation on inheritance to resolve disputes that arise in practice.
