Abstract:
Attendance of the bar on legal grounds (see paragraph 6, part 4, article 56 in Penal Code of Practice of Russian Federation and part 3, article 82 of Republic of Kazakhstan) during the state of witness evidence nominally turns a man into participant of trial, called as "barrister of the witness " for convenience. In addition to the bar who presents on examination of the witness but disappoints with participant of criminal procedure or others who take part in it. Owing to it barrister of the witness as the participant of trial is illegal. The presumption of criminal procedure is proposed to adopt the following, that any person who hasn’t got the status party of criminal procedure by means of providing him subject (personal) rights. Such person shall not be represented in a trial, be a member and parties to the proceedings and so shall not be admitted to it and operated with a certain legal (processor) name.
