A distinction between the concepts of Fascism and Nazism in the domestic legal system

Task: Nowadays, the topic of reviving Fascism and Nazism is becoming increasingly the subject of discussion of various scientific and legislative assemblies. The only way to deal with this threat is a good regulatory structure, which should contain clear notions of the studied criminal facts. However, the domestic legislation does not contain definitions of Fascism and Nazism, as well as tools for their distinction. It significantly complicates the fight against them. This study is necessary to highlight the existing concepts of Fascism and Nazism in doctrinal sources as well as to disclose the attempts to introduce and distinguish these concepts in the domestic legal system. Model: The analysis of scientific literature and regulatory legal acts of Russia was conducted to determine the existence of the concepts of Fascism and Nazism and the distinction between them. Conclusion: The domestic legal system doesn’t contain concepts and methods of the distinction between Fascism and Nazism. Moreover, the existing norms bring even greater contradictions to this problem. It is confirmed the necessity to deal with these phenomena at the state level. It isn’t clear, however, how to deal legally with criminal facts to be not given an official concept. Originality: The scientific article contains debating points and it is one of the fewest studies of the concepts of Fascism and Nazism from the point of view of domestic legislation.
