Abstract:
The article analyzes the actions of participants of transactions of credit institutions, committed on the eve of the bankruptcy of integrity, difficulties in assessment of the circumstances out transactions outside of normal business activities and its consequences. On the basis of the analysis of judicial practice the necessity of working out by higher judicial bodies criteria of proofs of good faith and directions of research in the pre-bankrotny period is shown.
