ON THE SUBJECT OF PROSECUTOR'S SUPERVISION OVER OPERATIONAL-INVESTIGATIVE ACTIVITY IN THE ORGANS AND INSTITUTIONS OF THE PENAL SYSTEM

Objective: the article analyzes the provisions of the Federal laws of the Russian Federation "on the Prosecutor's office of the Russian Federation", "on operational-search activity", regulating the implementation of Prosecutor's supervision over operational-search activities, as well as the existing problems of legal regulation in the implementation of Supervisory functions in the bodies and institutions of the criminal-Executive system. Methodology: formal-legal and comparative-legal methods were used in the preparation of the article. Conclusions: taking into account the established problems of legal regulation of the procedures under consideration and problematic issues arising in the enforcement activities of bodies and institutions of the UIS, formulated proposals that can be used in the development and improvement of joint departmental regulations. The scope of the study/the possibility of subsequent use of the results of scientific work: the individual aspects set out in the article that characterize the problems in determining the subject of prosecutorial supervision over the implementation of operational search activities can be used in the course of scientific research. Practical significance: the proposals and recommendations formulated by the authors can be used in the process of developing departmental regulations and improving the criminal enforcement legislation. Social consequences: the article is of scientific and practical interest, which is important for determining the subject of prosecutorial supervision of operational-search activities and the order of its implementation. Originality / value: the work is intended for scientists, professionals and a wide range of readers interested in the resolution of legal regulation problems arising in the implementation of operational and investigative activities in the organs and institutions of the penal system.
