Abstract:
Extraordinary circumstances and difficult conditions of adoption of the Bosnian Constitution of 1995 substanstially influenced its structure and content. As a result, the Constitution secures asymmetric division of powers in the State, with significant powers of the institutions of external control. The above features of the new Bosnian statehood had a direct impact on the place and role of the Constitutional Court of Bosnia and Herzegovina in the system of state power of Bosnia and Herzegovina. Consequently the Constitutional Court became an important element of the system of checks and balances in the State. The article presents an analysis of the powers of the Constitutional Court as part of the system of checks and balances in Bosnia and Herzegovina
