Abstract:
The purpose of the study is to assess the prospects for establishing in the provisions of Article 137 of the Criminal Code of the Russian Federation on violation of the privacy of the responsibility for the stalking - harassment of a person, associated with gross interference in the sphere of his private life. The materials and methods used in writing the study include a comparative legal analysis of the legislation of foreign countries, a statistical analysis of the application of the provisions of the Criminal Code of the Russian Federation on the protection of privacy, and the study of forms of unlawful behavior covered by the concept of "stalking". The practical significance of the research is that the author proposes a fundamentally new instrument for legal protection of the inviolability of the private life of citizens. The implementation of the author's proposal will enhance the effectiveness of the criminal and legal protection of the constitutional rights of the individual. Conclusions: current legislation on the protection of privacy requires improvement: the criminalization of the phenomenon of stalking as a widespread and currently unpunished encroachment on the individual.
