Abstract:
The Constitution of Bosnia and Herzegovina was developed in the peaceful negoniations over settlement of the "Bosnian conflict." In fact, its adoption and the signing in late 1995 as an Annex to the Dayton agreement marked the end of the civil war in Bosnia and Herzegovina. The circumstances and conditions of adoption of the Constitution of Bosnia and Herzegovina had a direct effect on the system of state authorities, which it established. Basic role among these organs is played by the constitutional court of Bosnia and Herzegovina. It was offered by the authors of the Constitution as the main element of the system of checks and balances in the state. The article presents the analysis of formation of Bosnia and Herzegovina's Constitutional court with regard to its legal nature and place in the system of state authorities. The author, while noting the shortcomings of the procedure of constitutional judge's election, makes proposals concerning the improvement of the formation of Bosnia and Herzegovina's Constitutional court.
