Task. The changes of the penal legislation concerning establishment of criminal liability for new types of criminal associations (extremist community, the extremist organization, terrorist community, the terrorist organization) caused difficulties in law-enforcement activities and a discussion in the scientific environment, in particular the ratios of such associations and the related crimes connected with determination. The author set the task for himself to create the recommendations allowing to draw lines between criminal and legal concepts of the specified criminal associations. Model. In article criminal and legal concepts of extremist community, extremist organization, terrorist community, terrorist organization taking into account the current legislation, modern court practice and urgent scientific research in the field are consistently compared and differentiated. Conclusions. The author creates set of the conclusions opening the legal nature of each of terrorist and extremist criminal associations, allocated in the penal statute, and allowing to determine their ratio among themselves. Possibility of the subsequent use of results of scientific work. Conclusions and other provisions of article can be used in educational activity within training of students of law departments and professional development of judges and law enforcement officers. Practical value consists in a possibility of use of recommendations of the author at qualification of crimes of a terrorist and extremist orientation during the investigation and considerations of the corresponding criminal cases. Originality/value. The author one of the first considered a ratio of extremist community, extremist organization, terrorist community, terrorist organization taking into account short stories of the penal legislation. Work is intended for judges, lawyers, law enforcement officers, students and graduate students studying the criminal law and also scientific and pedagogical workers of a legal profile.
