Constitutional Procedure in the Constitutional Court of Italy

The present article analyses the problem of judging in the Constitutional Court of Italy. The author reviews procedure of adoption of decisions on finding an act contradictory to the Constitution of Italy in the Constitutional Court of Italy. The core part of the research is dedicated to the special opinion of the Constitutional Court judges. The Constitutional Court of Italy does not let the judges which disagree to the judgement to give their special opinion publicly. The author resumes that a conflict between decisions of the Constitutional Court of Italy and of the European Court on Human Rights as well as controversial decisions of the Constitutional Court itself on similar questions show conflict of the Italian legislation which is to be eliminated.
