Abstract:

Purpose. To research the procedure of financial recovery, its efficiency, problems of its enforcement and ways of legislation improvement in this area. Approach. During the study of this problem, the author relied on theoretical studies of Russian and foreign scientists studied the statutory acts both existing laws and draft laws. The method of comparative law was used; the statistics of rehabilitation procedures application during bankruptcy was also applied. Findings. The author reveals the reasons that prevent the effective implementation of the financial recovery procedure and suggests the ways of improving the legislation for more effective application of the procedure.
