PROSPECTS OF IMPROVEMENT OF INSTITUTE OF ADVOCATE'S INVESTIGATION

The article discusses the changes in the Russian legislation that would allow advocates to more effectively carry out search and introduction to the materials of the criminal case of evidentiary information. The author carries out the critical review of the means of advocate's investigation on sample survey of persons with their consent, substantiates the necessity of cooperation between advocates and persons, organizations, which professionally looking for evidentiary information, the necessity of the legislative regulation of partnership between advocates and private detectives. In the scientific work analyzes the amendments in the Russian criminal procedure legislation, in particular, the article discusses the bill № 99653-7 «On amendments in the Criminal Procedure Code of the Russian Federation». For solve the problem of subjective discretion in resolving motions of advocates, the author proposes to introduce the institution of judicial deposition of evidences, with the aim of strengthening of state's guarantees of implementation of advocate activities to establish criminal liability for obstruction and interference in the professional activities of an advocate. The scientific results can be used for the amendments of the Criminal Procedure Code of the Russian Federation and of the Federal Law «On Advocacy and the Bar in the Russian Federation».
