Abstract:

The article discusses the penitentiary law as a sub-branch of the criminal-executive law. The conclusions on the understanding of the sub-branch of law are summarized. The author establishes the key features characteristic of the sub-branch of the criminal law. The paper draws attention to the criteria for the formation of the sub-branch of the criminal-executive law. As a result of the analysis of general, substantive and functional institutions of law the structure of penitentiary law is determined. It is concluded that in the system of criminal-executive law the penitentiary law is allocated on the basis of differentiation, specialization and integration of the regulations of the criminal-executive law.
