Abstract:
The purpose of the research carried out in the article is to consider the theoretical problems of legal regulation of relations on the liability of the employer for damage caused to the property of an employee related to the ongoing debate in the science of labor law about the sectoral nature of these relations. In this regard, it is not clearly defined by the norms of which branch of law-labor or civil law should be carried out legal regulation of the analyzed relations, which does not give a clear idea of the concept of material responsibility of the employer. For achievement of this purpose the author sets the following tasks: to reveal the reasons of emergence of the specified discussion; to carry out the analysis of the scientific positions occupied by various scientists-civilists about the civil nature of the relations on compensation of the damage caused to property of the worker; to carry out the comparative analysis of legal regulation of these relations by norms of the labor law and regulation of the relations on compensation of the harm caused to property of the citizen, the civil legislation; to determine the features of the relationship on the liability of the employer for damage caused to personal belongings of the employee; to draw conclusions about the legal nature of the relationship for compensation for damage caused to the property of the employee. The need to solve these problems caused the need to use such methods of scientific knowledge as General scientific (analysis, synthesis, analogy, generalization, classification) and special legal (comparative legal, legal - technical, dogmatic). The scientific novelty of the article is that it is the first study specifically devoted to the clarification of the legal nature of relations for compensation for damage caused to the employee's property. A special contribution to the study of the employer's liability for damage caused to the employee's personal belongings is the conclusion made by the author about the nature of labor relations for compensation for damage to the property of the employee, which will increase the effectiveness of the legal mechanism for protecting the labor rights of workers. This article may be of interest to researchers, employers, legal advisers, human resources managers and other practitioners, and can also be used in the educational process teachers, graduate students, masters and students of law universities and faculties.
