Abstract:

The question of opportunity reference of public safety to complex objects of a crime is considered in article. On the basis of the analysis of provisions of criminal law science and law-enforcement practice the conclusion that complex character of the relations of public safety is caused by the general danger is drawn. As the basis of inclusion of the public relations in a complex of public safety the fact of direct criminal legal protection of such relations within a crime opposes the public safety which is defined with all elements of corpus delicti. The consequence of complex nature of object of a crime for qualification of crimes shouldn't concern the public relations which are directly not entering a complex of public safety, though indirectly guaranteed within public safety. The drawn conclusions matter as for judgment of public safety as object of a crime, and for law-enforcement activity.
