The article examines and assesses the situation in the field of defense practice of our state over the past 20 years, during which no such criminal punishment as the death penalty was applied. The article gives different opinions of supporters and opponents of the abolition of the death penalty, draws attention to the difficulties and problems of abolishing the death penalty in other countries. It is noted that the abolition of the death penalty in Russia did not lead to a "collapse" in the growth of murders and other grave and especially serious crimes. There are serious doubts about the superiority of the preventive potential of the death penalty in comparison with other criminal penalties. Methodology. When writing the article, the dialectical method of cognition was used, as well as the formal legal, comparative legal and systemic methods of investigation. Conclusions. The Russian state in modern conditions can do without this measure of criminal punishment, while effectively fighting crime. Undoubtedly, the readiness of the majority of the population to accept the abolition of the death penalty is important for the abolition of the death penalty. At present, the situation has come for the successful completion of the procedure for excluding from the Criminal Code of this type of punishment. The article is of practical importance, since it can be used in the teaching of the discipline "Criminal Law", as well as a material explaining to the population the possibility of the state to protect it and without such punishment as the death penalty.
