VIOLATION OF CRIMINAL PROCEDURAL LAW AND ITS SIGNIFICANCE IN CRIMINAL PROCEDURE

Abstract:
The purpose of this article was the need to form a clear idea among the law enforcers what violation of criminal procedural law during preliminary investigation, is significant. As it is impossible to completely avoid violations of the law the enforcer needs to know which violation will result in the inadmissibility of evidence, which violations are grounds for returning the criminal case to the Prosecutor according to article 237 code of criminal procedure, which violations are taken into account when assessing the impact of tightness or restriction of the rights of the parties. This article considers violations of the criminal procedure law committed during the preliminary investigation of a criminal case and their significance in criminal proceedings. The article analyzes the opinions of scientists on this issue. The Code of criminal procedure contains a specific list of violations of procedural law that are significant, but all violations relate to the stage of the trial. There is no list of significant violations at the stages of preliminary investigation in the law. The criterion for classifying a violation as significant or insignificant in the code of criminal procedure is rather vague, which allows the law enforcement officer to decide the question of significance of the violation at his discretion, which makes it impossible to establish a uniform practice for assessing violations of the law. The author sees the solution of the problem in the introduction of judicial precedent in criminal proceedings and the legislative establishment of rules for investigation of evidence. The provisions of the article are aimed at establishing a uniform practice of distinguishing violations committed in the pre-trial stages of criminal proceedings, in order to determine the material violations, which will make it possible to take a legitimate and reasonable court decision.
