Abstract:
The article discusses the general theoretical bases of qualification of crimes. The author defines the main stages of development. Based on the data obtained, the author indicates the group which rules constitute competing and related standards, which art. 159.6 of the Criminal Code requires a distinction between: competing standards - art. 159 of the Criminal Code "Fraud" and art. 159.3 of the Criminal Code "Fraud with payment cards," related regulations art. 158 of the Criminal Code "Theft", art. 272 of the Criminal Code "Illegal access to computer information"; art. 273 of the Criminal Code "Creation, use and distribution of malicious computer programs"; art. 274 of the Criminal Code "Violation of the rules of operation of the storage means, processing or transmission of computer and information and telecommunications networks."
