Abstract:
In the article the author poses the tasks of studying the historical development of guarantees for the protection of the weak side of contracts. The author carried out a historical analysis of the notions of the need to protect the weak side of the treaty, including in contractual relations with the participation of the entrepreneur, enshrined in various legislative acts of different countries and at different periods of law development through comparative legal, historical and other research methods. As a result of the analysis the essence of this phenomenon the reasons for its occurrence that need for legal regulation and factors contributing to the understanding of the institution of protection of the weak side in the civil legislation in the Russian Federation are clarified. In addition the author proves that the scope of guarantees provided to the weak side of the contract has changed depending on the political and legal changes in the society. The conclusions made in the article will be used to further develop practical mechanisms for protecting the weak side of contractual relations.
