Abstract:
The author examines the relationship between the concepts «source of law», «historical monument», «a monument to the right», «legislation monument», etc. It is shown that in contrast to the historical sciences, where the concept of «source of law» was studied only as a special case the concept of «historical source» in legal science in general and the historical and legal in particular, this category is one of the basic concepts. Approaches to the study of the concept of «source of law» in the legal science in general and the historical and legal in particular also differ, as the former tend to deal with all the legal processes in terms of dogma rights, while the second explores the historical background of the emergence of certain norms, branches of law, legal documents, their development in historical retrospective.
