The substantive family law of presumptions arising from marriage, in the Russian Federation, in CIS countries and Baltic States

The paper highlights the challenges of establishing and actions in family law the most common material presumptions: the presumption of validity of a marriage, the presumption of community of property, spousal consent to the transaction by the order of the common property, perfect the other spouse, as well as the presumption of paternity of the child born to a mother of her husband by her. On the basis of a comparative analysis of family law neighboring countries, providing an opportunity to assume the existence of certain circumstances, and thereby facilitate their proof, the authors come to a conclusion about the possibility and expediency of further improvement of the institute of material presumptions in the family law of the Russian Federation. The work may be useful to students, graduate students, university professors, researchers and practitioners whose work is related to the application of family law.
