Abstract:
The article is devoted to the question of rights, duties and responsibility of the examiner entrusted with the conduct of judicial review in civil and arbitration process. The author analyzes the procedural legislation for the identification of the purpose and nature of activities of the expert at different stages in the performance of their functions. Also considers the problem of implementing an expert of rights and duties in legal proceedings in civil and arbitration process. The findings allow to reveal the legal status of an expert in at different stages in civil proceedings in relation to the rights of persons participating in the case. Expressed by the author of the proposals on improvement of legislation aimed at improving the efficiency expert and enforcing the rights of persons participating in the case, during the judicial examination of the expert's conclusion. The article can be useful for students and graduates of law schools, lawyers, judges, experts, scientists and teachers.
