Abstract:
Background: Presently, searching for solutions of the problem related to developing a theoretically substantiated and efficiently operating system of standards providing for an unbiased determination for the limits and implementation level of the private property right is of great importance. To this end, it is necessary to comprehend, in the first place, the constitutional practice relating to guaranteeing the right. A comparative legal analysis of how the private property right is provided for and implemented by the example of Russia and the United Kingdom carried out by the author based on studies conducted by such Russian and foreign researchers as V. Banning, P. Grossman, D. Cole, etc., will provide a deeper insight into the problem. Materials and methods: Based on the analysis of respective legislation as well as a broad range of Russian and foreign sources of literature, the author describes the present-day situation with the implementation of constitutional private property rights in the Russian Federation and the United Kingdom. Conclusions: The present-day situation with the constitutional and legal support of the private property right as a legal form to implement the personal liberty in economic relations can be characterized by a number of problems, which include, first of all, absence of a systemic approach to the definition of the economic order in the Russian Constitution. Provision of an efficient mechanism of legal restrictions to ensure a balance between the subjects’ interests in the course of exercising their private property right as well as stronger constitutional guarantees of the right may solve the problem.
