Abstract:
Background: Presently, the constitutional right to freedom of enterprise and particular features of its exercise in Russia and the United Kingdom is an urgent issue. Such foreign researchers as H. Wade, R. Megarry, A. Eide, etc. paid attention to this issue as well. All European constitutions provide for the right to carry out business activities when a person uses his or her abilities and property as a basis of market relations. In fact, entrepreneurship is an integral part of the market economic system. Without it, normal existence and development of the economy and society in general is impossible. Materials and methods: The author analyzed scientific literature and statistics to find out how the constitutional right to freedom of enterprise is exercised in Russia and the United Kingdom. Conclusions: Russian lawmakers will find it useful to learn about the experience of EU and, in particular, the United Kingdom, in the field of improving the legislation and law enforcement relating to business activities. A complex and burdensome system for state regulation of economic activities is a serious obstacle to the development of business activities. On the basis of the analysis of respective statistics, a conclusion can be made that the basic characteristics of general business activities in the United Kingdom are higher than in Russia.
