Abstract:
Objective: to develop a unified idea of such categories as exemplified with the licensed appraiser (evaluator) on the basis of the scientific and comparative legal analysis of the contents of the categories of “legal status” and “legal standing” of an individual. The author’s conclusions are based on major papers in the fields by such scholars as N.V.Vitruk, N.I.Matuzov, P.B.Miller, M.N.Radzhabov, etc. Model: the correlation of the categories “legal status” and “legal standing” has been determined as applicable to individuals acting as appraisers. Conclusions: it has been defined that contents of the category “legal status” applicable to the licensed appraiser (evaluator) is narrower in volume than the category “legal standing”. An individual is vested with the legal status of the appraiser from the moment of their joining a self-regulated organization of appraisers. At the same time, the licensed appraiser shall only have the legal standing of the appraiser under a certain obligation to render appraiser’s services. That said, the category “legal standing of the appraiser” includes the “legal status of the appraiser” and other components, such as rights and obligations while holding an appraisal. Components of the civil legal status of the licensed appraiser have been highlighted. Research framework / feasibility for future application of results of the research: the results of the research can be applicable for further studies of the substance, structure, correlation of such categories as “legal status” and “legal standing” as applicable to individuals. Moreover, the stated conclusions can be as base for forming an idea of a civil status of an individual performing an appraiser’s activities, or for research of indications of such activities. Practical value: conclusions stated in this paper complement the doctrine of the legal status and the legal standing of a person or аn operator of an activity. Moreover, they can be used in the educational process while studying the course “Civil Law (General part and Special part)”, “Business Law”, or the special course “Valuation activities”. Social impact: elimination of discrepancies in terminology and in the applicable law facilitate an increase on the quality of rendering valuation services and, as a consequence, the most efficient achievement of application of results of the valuation by parties of civil relations. Distinction/value: the paper is the first attempt to define the correlation of the categories “legal status” and “legal standing” of the individual performing valuation activities considering the particulars of obtaining such status by the appraiser. The author’s position is stated that the legal standing of the appraiser cannot exist without the legal status of the licensed appraiser.
