SUBSTANTIATION AS A TYPE OF COGNITION AND ITS THEORETICAL AND PRACTICAL MEANING

Objective: The institute of substantiation in the criminal procedure is the main in the process of determination in the criminal case, that is why the research of this topic stays actual for decades. In this article is shown the matter of relation of the substantiation as a cognition and the substantiation as a practical action of gathering, verification and assessment of the evidence in the criminal case and some of the aspects of the direct investigation of the evidence by the interrogator, investigator and the court in the production of the criminal case. Model: In the article it is shown how the criminal procedure analysis of the signs of the substantiation are held, as well as the consideration of the controversial question of the direct research of the evidence in the court by using the video-conference communication. Conclusions: The author concludes that the substantiation in the criminal procedure is the mediated cognition, that is made by doing the direct research of the evidence of the committed crime by the subjects of the substantiation. Originality: In the article the institute of substantiation is observed from the philosophical point of view - research is made on the materialistic dialectics and the questions of the theory of reflection.
