Abstract:
The article is devoted to one of the most important issues of reorganization - the protection of the rights of creditors of a legal entity, which are under the reorganization procedure. The main attention the author is paid to three types of guarantees of rights provided by the Russian legislation. As a result of consideration of experience of foreign countries in comparison with the Russian legal instruments of protection of creditors' rights of the reorganized legal entity, the author comes to the conclusion that in the developed legal systems the guarantees of creditors' rights are given considerable attention, while the reorganization is carried out under the direct control of the state. There are three types of protection of creditors' rights in Russia, of course, aimed at creating an effective protective mechanism, but the legislative problems described in the article weaken its practical application.
