Separate Legal Categories Characterizing Crimes Committed in the Field of Procurement

Abstract: The article deals with the issues of legislative regulation of legal categories characterizing crimes committed in the field of procurement for state and municipal needs. The legislation regulating the sphere of procurement and the mechanisms of criminal law protection is analyzed. The purpose of the study is to identify and analyze the features of the legal regulation of such concepts as «procurement», «contract system» and others. This is necessary to determine the main directions of development of the Russian system of legislation. As a result of the conducted research, the author comes to the conclusion that the use of special concepts of sectoral legislation or terms of broad interpretation in the criminal law norm without taking into account their specifics and unification for the purposes of criminal legislation creates conceptual uncertainty. The current mechanism of criminal law protection of relations in the field of state and municipal procurement is no exception to this statement, which is reflected in the approach to determining objective and subjective signs of the composition of such crimes.
