Abstract:
This article analyzes the main trends in the modernization of the Criminal Code of the Russian Federation over the 30-year period since its adoption. These trends are driven by the dynamics of social relations at the domestic level and changing guidelines for interpreting the relationship between Russian and international law, amidst the new geopolitical situation in the world. The study examined 351 federal laws, each of which, taken together, reflects not only the quantitative but also the qualitative characteristics of the metamorphoses that have occurred in the General and Special Parts of the Criminal Code of the Russian Federation. Their essence can be summarized as follows: criminalization of acts prevails over their decriminalization; penalization of acts recognized as criminal over their depenalization; and differentiation of criminal liability over its dedifferentiation (unification). Furthermore, special attention is paid to the growing role of the Criminal Code of the Russian Federation as the main (basic) source of Russian criminal law at the present stage, the need to synchronize and harmonize the development vectors of its main structural components, and the advisability of adopting a new, optimized version of this code.
