On Problematic Aspects Related to the Traditional Economic Activities of the Indigenous Small-Numbered Peoples of the North in the Territory of the Russian Arctic Zone

The article analyzes the legal aspects of the status of Indigenous Small-Numbered Peoples of the North (ISNPN) in the Arctic zone of the Russian Federation. The author examines the population dynamics of the ISNPN based on data from the 2020 All-Russian Population Census, comparing these figures with the targets set out in the Concept of Sustainable Development until 2036, and concludes that claims of significant demographic growth are premature. The system of legal guarantees enshrined in Article 69 and clause (zh) of Article 72 of the Constitution of the Russian Federation, as well as in special federal laws No. 82-FZ, 104-FZ, and 49-FZ, is considered. Special attention is paid to the issues of legal regulation of entrepreneurial and economic activities of ISNPN communities, including the absence of a legal definition of “economic activities of the ISNPN” and the restrictions arising from the regime of territories of traditional nature use. Drawing on the legislation of the Republic of Sakha (Yakutia), positive regional practices are identified; however, systemic gaps at the federal level are noted. As the main conclusion, the necessity of adopting a comprehensive federal law “On Entrepreneurial Activities of Indigenous Small-Numbered Peoples of the North” is substantiated, and the introduction of a periodic census of the ISNPN every three years is proposed.
