Abstract:
The article analyzes the evolution of the concept of good faith (bona fides) as a fundamental category of private law, whose legal nature remains debatable. It examines the dualistic structure of good faith, combining a psychological element (excusable ignorance) and a normative-evaluative element (standard of honest conduct). The study explores the reception of Roman constructs of “actiones bonae fidei” in the German (§ 242 BGB) and French (Art. 1104 of Code Civil) models, as well as the development of the Russian civil law doctrine – from the works of pre-revolutionary scholars to the reform of the Civil Code of the Russian Federation in 2012–2013, which elevated the principle of good faith to the rank of fundamental principles of civil legislation. It is argued that digital transformation and the introduction of artificial intelligence give rise to new forms of bad faith conduct (algorithmic manipulations, automated abuse of rights) not covered by classical criteria. The author concludes that traditional good faith requirements must be supplemented with mechanisms of “algorithmic accountability” and consideration of the specificities of autonomous systems.
