COMPUTER INFORMATION IN CRIMINAL PROCEDURE: ESSENSE AND METHODS OF FIXING AS AN EVIDENCE IN CRIMINAL CASE

The author examines the problem of acquisition by computer information the status of evidence in criminal case. This problem is a subject of wide speculation of domestic scholars (Zigura N.A., Volevodz A.G. and others) and foreign scientists (Minny Narang, Orin S. Kerr). In this article author facing a following issue: is it possible to include computer information to one of the types of evidence specified in part 2 of article 74 Criminal procedure code of Russian Federation or we need to take it as a separate type of evidence? In process of searching the answer to this question author proves the possibility of referring electronic documents which not have a features specified in article 81 of the Code to category of other documents as evidence in a criminal case. Also author critically evaluates the findings of other researchers regarding the necessity of providing computer information as a special type of evidence. In the end of article author puts forward a proposal to extend the regime of collection and fixation of material evidence on computer information in electronic document and other forms when it have features which specified in article 81 of the Criminal procedure code. The findings in this articles will improve the process of collecting evidence in course of computer crimes investigations. The article is intended for scholars, investigators and prosecutors.
