Abstract:
In this article the author explores the concept, the legal nature and types of mortgage to secure the fulfillement of obligations in the law of India as well as the features of the contract of mortgage in law-enforcement practice in India. In the preparation of this article, the author applied the dialectical method of analysis, and educational opportunities which allow them to identify the real estate collateral in the system of methods of provision of obligations under the indian legislation. To prepare this article the author used the books and articles of British scientists, legal scholars, such as Phillip R. Wood, Sulton and Shannon, Charles Proctor, Sir Dinshaw Fardunji Mulla According to the results of this achievement: conclusions were drawn about the continuity of the mortgage in India from the English colonial law, and that an anomalous mortgage (anomalus mortgage), usufructuary mortgages are specific mortgages under the legislation of India
