Abstract:
In the article the author considers theoretical position of change of conditions of employment contract. The analysis of scientific definitions of change of employment contract, given his own definition of this notion. It is concluded that the actions of the parties to change the labor contract shall comply with the requirements of the labour legislation in respect of the subject composition: the possession of parties with the required volume of standing and legal capacity; freedom of the will and the will of the employee and the employer; of changes form of the employment contract and its content. The author considers that articles 75 and 76 of the Labour code of the Russian Federation do not apply to changes in forms of employment contract (as they are connected with the further action of the employment contract) and proposes changes to the structure of the Labour code of the Russian Federation.
