Abstract:
In the present article deals with the prospects for the use of the mechanism of self-regulation in the organization of the mediators. Currently, the activities of mediators as an alternative to traditional methods of resolution of civil disputes is regulated by federal law, which directly points to the possibility of combining mediators in self-regulatory organizations. However, despite the obvious advantages, which has a mechanism of self-regulation in this type of service, only a small part of the organization is registered as a self-regulating neurotransmitters. The problem with self-regulation actively discussed by leading experts in the field of mediation, which is carried out to find the most effective forms of organization in the field of services of mediators, but acceptable solution has yet been found. The article is an attempt to justify the need for management of the mediators through self-regulatory organizations. This article provides a brief history of the development of mediation, its general characteristics, the main differences from the traditional methods of conflict resolution, shows the advantages that gives self-regulation, and the ability to effectively address the challenges facing the community mediators Russia. Logically, the importance of the professional activity of mediators is based on self-regulation. It is proposed to reflect the number of functions that are not included in Art. 19 of the Law on Mediation in the legal acts of local self-regulated organization of mediators. Securing the features offered in the local normative regulation of self-regulated organization of mediators can provide substantial social results, and it will increase the level of professionalism of practicing mediators required for the successful resolution of conciliation procedures as well as improve the overall efficiency of control over the activities of mediators. Suggestions may be of interest for further discussion and constructive criticism from scientists and experts in the field of mediation. A number of provisions put forward in this paper can also be used for the formulation of principles and standards mediatorskoy activities, formation of educational-methodical bases of training of mediators
