Abstract:
At the stage of construction of the market economy in Russia, gets specific actuality to study the mechanism of realization of legal guarantees of economical rights and freedoms of Russian Federation citizens. It is suggested that the base of that mechanism must have optimally balanced combination of publicly conditioned and private law methodologies of regulatory impact on regulated relations with considering complex systemic importance of provided events and processes, both for private economic interest and countries economic) in the case of foreign economic activity - and for economy of two and more obligation related countries, respectively). Doctorian beginning of this study exists in works of this authors: S.V. Belyh, V.I. Kruss, G.B. Mirozev, I.N. Plotnikovoi and etc. Other scientists have studied economical rights and mechanism of providing its realization, combined with social guarantees, in particular, N. Varlamova and I.B. Mihailovskaya. In the presented analyze is substantiated the conclusion, made on base of complex of theoretical and practical analysis of economical rights and freedoms of citizens of Russian Federation, that their quite full and effective realization must be materialized through a combination of methodology of regulation public law and private law beginnings, and also different sectoral instrumentaries, both state-legal(constitutional) and sectoral, cross-sectoral. In general, economic rights and freedoms are shown as a complex cross-sectoral legal category, which is presented as fundamental element of legal status of personality and citizen of Russian Federation.
