Abstract:
The author has made a comparative analysis of the relations between the lender-pledge holder and the borrower-pledgor, has revealed the differences of mortgage agreement regarding property the right to which will arise in the future, from mortgage agreement regarding the right of claim on partnership agreement in construction regulated by the Law No 214-FZ. The conclusion has been made that pledge of right of claim on partnership agreement is a more reliable means for the pledge holder to secure performance of obligations under loan agreement.
