Abstract:
In this article the author determines the juridicial structure of fiducia based on leasing hypothecary law and global practice of its use. Suggested juridicial model is based on the property interests of the parties, leasing company, leaseholder and leasing subject vendor in particular. The mechanism of fiducia in the lease agreement is determined in this article in order to solve the problem of adequate mapping of economic relations between the parties of the leasing agreement. Moreover, the author defines a concept and juridicial peculiarities of fiducia, as the way of securing primary obligations on repayment of money, given by leasing company on getting defined property, by leaseholder.
