Abstract:
Both studying the main issues of identification of the optimum methods of entrepreneurial legal relationship inspection and formulation of the foundations of implementation of this regulating influence upon the peculiar kind of economic activity - entrepreneurship are urgent in Russia, where market economy has not developed enough yet. The doctrinal origin of the made research belongs to transactions papers of following authors: V.S. Anokhin, V.K. Andreev, O.V. Pleshakov, A.P. Vershinina. The works of many foreign authors are also dedicated to studying the problems of the defence of entrepreneurs’ rights, for example the works of Austrian civilian E. Messner. During the research this conclusion was made: as of today, the institute of the defence of juridical persons’ and sole proprietors’ rights is in the phase of optimization of regulatory guaranteeing during realization of state and municipal control (oversight); elaboration of complex legal approach that let value society’s requirement in determination of such and such limits with regard to entrepreneurs and the type of probable negative effects for subjects of entrepreneurship because of these legal determinations. The practical value of made conclusions is possibility of use of them during the further studying of scientific, normative and enforcement feasibility study of used limitations towards subjects of entrepreneurial activity and their impact on efficaciousness the entrepreneurial sector of the economic
