ORDER OF INHERITANCE OF THE UNPAID AMOUNTS PROVIDED TO THE CITIZEN AS MEANS OF SUBSISTENCE

The purpose of this research is to determine the characteristics of the order of inheritance of the unpaid amounts provided to the citizen as means of subsistence, and development of recommendations for resolution of problems in law enforcement. Methodological basis of research is the general scientific dialectic method, which assumes the objectivity and comprehensiveness of knowledge of the studied phenomena. The research employed system, comparative legal, logical methods of scientific knowledge. During the study we came to the conclusion that the laws governing the order of inheritance of the unpaid amounts provided to the citizen as means of subsistence, requires changes. We made proposals to amend the legislation in the sphere of the considered legal relationship, in particular, we have developed recommendations for elimination of deficiencies of the Labor code of the Russian Federation, Decree of the Plenum of the Supreme Court of the Russian Federation «On judicial practice of cases of inheritance». The practical significance of the research is that the conclusions and suggestions can be used in the improvement of the legislation on inheritance, and also in enforcement activity of the courts. The results of the research can be used in teaching courses: «Civil law», «Inheritance law», in preparing study guides, scientific works. The value of this research lies in the fact that the proposed specific changes in the legislation on inheritance to resolve disputes that arise in practice.
