THE ARBITRATION AGREEMENT AS A FACTOR OF ARBITRABILITY OF A BUSINESS DISPUTE

The aim of this article is to study legislative innovations on arbitration agreements, in light of adoption and coming into force of federal laws No. 382-FZ «On arbitration in the Russian Federation» of December 29, 2016 and №. 409-FZ «On amendments to certain legislative acts of the Russian Federation and the annulment of article 6 section 1 clause 3 of the Federal Law «On self-regulatory organizations» in light of adoption of the Federal Law «On arbitration in the Russian Federation»» of December 29, 2015. This article uses the work of Gerhard Saria, LL.M., Ass.-Prof. of the Civil Law Faculty at the University of Applied Sciences Wiener Neustadt (Vienna, Austria) co-authored by Natalia Levanova, «ARBITRATION OF CORPORATE DISPUTES» (Self-Government, 2012, №. 1, Publishing House: Free Economic Society of Moscow). This is one of the first publications that discusses new ways for the parties to enter into written arbitration agreements, new rules for admissibility of a dispute as the subject of arbitration proceedings in the Russian Federation, and the rules for arbitrability of corporate disputes established by the federal laws №. 382-FZ of December 29, 2016 and №. 409-FZ of December 29, 2015. The range of problems perceived by the authors can find its further coverage in publications addressing the arbitrability of business disputes in the Russian Federation. This work is intended for the authors whose studies address theoretical and practical aspects of execution of the arbitration agreement, as well as for a wide range of legal practitioners whose field of interest is related to arbitration proceedings.
