Abstract:
In the modern era of global changes before our country had the unique opportunity to turn legal reform towards national priorities. However, the classical theory of state and law in the classification of the world's legal systems makes it impossible for the self-determination of our legal system on the basis of national specificities. It is therefore necessary to look for new approaches to the theory of state and law, in particular comparative law, which would take into account the legal mentality as a basis of national originality of the Russian legal system. In this article, the author comes to the conclusion, that building a new legal system can be successful only under condition of preservation of the old legal traditions with consideration of peculiarities of legal culture.
