Abstract:
This article explores the problems existing in the legal regulation of contractual relationships which are making surrogacy. Particular attention is drawn to the lack of consensus on the legal nature of the contract, its legal definition, legal forth the rights, duties and responsibilities of the parties for breach of obligations. Conduct a comparative legal analysis of the Russian and foreign legislation. In conclusion, the article concludes that the civil- legal nature of the contract of surrogacy, and its proximity to the obligations under the paid services.
