Abstract:
The article deals with entrepreneurial freedom as guaranteed by the Russian Constitution of 1993. The analysed case of the transport group «Confidence» highlights a double conflict, where the question of classic public body’s intrusion into the sphere of an individual constitutional liberty is aggravated by the latent conflict of bearers of the same constitutional right (=entrepreneurial freedom), namely two groups of businessmen, involved in the same kind of commercial activity. The author criticises the controversial decision of the Komi Constitutional Court for having failed to properly assess both the public and private law dimensions of the analysed case.
